Abstract

Promocijas darba „Ietekmes uz vidi novērtējuma tiesiskā regulējuma aktuālas problēmas” mērķis ir izstrādāt un analizēt ietekmes uz vidi novērtējuma (IVN) efektivitātes algoritmu mūsdienīgā kontekstā. Autore analizē un attīsta teorētiskās atziņas par IVN izpratni, pilnveido IVN zinātnes teoriju attiecībā uz šī starpdisciplinārā tiesību institūta būtību un saturu, tā piemērošanas iespējām un ierobežojumiem. Pētījumā tiek izstrādāta IVN efektivitātes koncepcija saistībā ar IVN zinātniskajiem un tiesībpolitiskajiem uzstādījumiem komparatīvā skatījumā un novērtēta sabiedrības līdzdalības loma IVN tiesību normu piemērošanā un efektivitātes paaugstināšanā saskaņā ar plurālisma paradigmu. The aim of the doctoral thesis ‘Current Issues of Legislation on Environmental Impact Assessment’ aim is to develop and analyze the environmental impact assessment (EIA) effectiveness (performance) algorithm in a modern context. The author analyzes and develops theoretical knowledge on the understanding of the EIA and makes contribution to the EIA’s science theory as regards the nature and content of this interdisciplinary law institute, its feasibility, and limitations. Next, the research develops EIA effectiveness concept concerning the scientific and judicial settings of the EIA in a comparative view and assesses the role of public participation in the application of EIA law and raise of its effectiveness in line with the paradigm of pluralism.
