Problemātika mantojuma lietu vešanas procesā notariātā

Abstract

Pētījums aptver praksē aktuālo problēmjautājumu analīzi mantojuma lietu vešanas procesā notariātā. Atbilstoši katrai procesuālajai stadijai mantojuma lietas vešanas procesā tiek aplūkoti raksturīgākie problēmjautājumi, izdarīti secinājumi un izvirzīti priekšlikumi problēmas risinājumam. Pētījums strukturāli ir iedalīts trīs mantojuma lietas vešanas stadijās, proti, mantojuma lietas uzsākšana, ar mantojuma lietas vešanu saistītās darbības, pēc mantojuma lietas ir uzsākšanas un mantojuma lietas pabeigšanas stadija. Kā viens no galvenajiem autores izvirzītajiem pētījuma mērķiem bija digitālas mantojuma lietu vešanas sistēmas izveide un tās funkcionalitātes pārbaude praksē, kas arī tika realizēts un atzinīgi novērtēts no zvērināta notāra puses. Kā risinājumu citiem aktuālajiem mantojuma lietu vešanas problēmjautājumiem autore izvirzīja priekšlikumu vairāku Civillikuma, Notariāta likuma un Ministru kabineta 04.08.2008. noteikumu Nr.618 “Noteikumi par mantojuma reģistra un mantojuma lietu vešanu” normu izteikšanai jaunā redakcijā.

The study covers the analysis of the actual problems in practice in the process of conducting inheritance cases in the notary office. In accordance with each procedural stage in the process of managing the inheritance case, the most characteristic issues are considered, conclusions are drawn and proposals are put forward for the solution of the problem. The study is structurally divided into three stages of the inheritance case, namely the initiation of the inheritance case, the activities related to the inheritance case when the inheritance case has been initiated and the stage of the completion of the inheritance case. As one of the main objectives of the author's study, the creation of a digital heritage case management system and its functionality testing in practice, which was also implemented and appreciated by a sworn notary, was one of the main objectives of the research. As a solution to other current problems in the management of inheritance cases, the author put forward the proposal of several Civil Law, Notary Law and the Cabinet of Ministers on 04.08.2008. of Regulation No. 618 "Rules on maintaining the inheritance register and inheritance cases" for expressing the norms in a new version.
