Pašvaldību saistošie noteikumi, kas noteic administratīvo atbildību: aktuālās problēmas

Abstract

Pašvaldību domes, pamatojoties uz likumā ”Par pašvaldībām” un Pašvaldību likumā paredzētajiem pilnvarojumiem, ir izdevušas dažāda satura pašvaldību saistošos noteikumus, kuros paredzēta administratīvā atbildība par saistošo noteikumu prasību neievērošanu. Tomēr pašvaldību saistošo noteikumu administratīvās atbildības regulējumā identificējamas dažādas juridiska rakstura problēmas: administratīvās atbildības paredzēšana par administratīvajiem pārkāpumiem, par kuriem atbildība paredzēta likumos, pašvaldības saistošo noteikumu normu izdošana neatbilstoši likumā paredzētajam pilnvarojumam, tiesiskās noteiktības principa neievērošana, administratīvā akta izdošanas prioritātes principa neievērošana, prettiesiska administratīvā pārkāpuma procesa veicēja pilnvarošana un atšķirīgs administratīvo sodu regulējums par salīdzināmi identiskiem pārkāpumiem. Darba mērķis ir apskatīt raksturīgākās problēmas, kas saistītas ar pašvaldību saistošo noteikumu administratīvās atbildības regulējumu. Darba uzdevums ir formulēt raksturīgākās problēmas pašvaldību saistošo noteikumu administratīvās atbildības regulējumā, kā arī piedāvāt autora redzējumu uz formulēto problēmu risinājumiem. Pētījuma gaitā tika izdarīts secinājums, ka pastāv pašvaldību saistošo noteikumu tiesiskais regulējums, kas dublē likumu tiesisko regulējumu, kas izdots bez atbilstoša pilnvarojuma un kura izstrādē pieļautas citas juridiskas kļūdas. Municipal councils, on the basis of the authorizations provided for in the Law "On Municipalities" and the Law on Municipalities, have issued binding regulations for municipalities of various content, which provide administrative liability for non-compliance with the requirements of the binding regulations. However, various problems of a legal nature can be identified in the regulation of the administrative liability of the binding regulations of local governments: provision of administrative liability for administrative violations for which liability is provided by law, issuance of binding regulations of the municipality inconsistent with the authorization provided for in the law, non-observance of the principle of legal certainty, non-observance of the priority principle of issuing an administrative act, illegal administrative violation authorization of the person in charge of the process and different regulation of administrative penalties for comparably identical violations. The aim of the work is to examine the most typical problems related to the regulation of administrative liability of binding regulations of local governments. The task of the work is to formulate the most typical problems in the regulation of administrative liability of the binding rules of local governments, as well as to offer the author's vision of solutions to the formulated problems. In the course of the research, it was concluded that there is a legal regulation of binding regulations of local governments, which duplicates the legal regulation of laws, which were issued without proper authorization and in the development of which other legal errors were made.
