Pamattiesību aizskārums kā konstitucionālās sūdzības pamatelements

Abstract

Darbā tiek izpētīts pamattiesību aizskārums kā konstitucionālās sūdzības pamatelements. Darba ietvaros tiek analizēts konstitucionālās sūdzības institūts konstitucionālās kontroles kontekstā. Bakalaura darba uzdevums ir padziļināti pētīt pamattiesību aizskāruma esamības priekšnoteikumus un identificēt to izvērtēšanas problemātiku Satversmes tiesas praksē. Satversmes tiesas judikatūrā nav izstrādāta vienveidīga un strukturizēta metodoloģija pamattiesību aizskāruma esamības izvērtēšanai, tāpēc darba mērķis ir izvirzīt pamattiesību aizskāruma izvērtēšanas kritērijus un aktualizēt attiecīgas metodoloģijas izveidi Satversmes tiesas judikatūrā. Bakalaura darba mērķa sasniegšanai tiek izmantota Satversmes tiesas prakses, ārējo normatīvo aktu un tiesību doktrīnas izpēte un analīze.

The Bachelor’s thesis examines the infringement of fundamental rights as a fundamental element of a constitutional complaint. The Bachelor’s thesis analyses the institution of constitutional complaint in the context of constitutional review. The task of the Bachelor’s thesis is to study in depth the prerequisites for the existence of an infringement of fundamental rights and to identify the problems of their assessment in the practice of the Constitutional court of Latvia. Constitutional Court of Latvia has not developed a uniform and structured methodology for assessing the existence of an infringement of fundamental rights, therefore the aim of the Bachelor’s thesis is to put forward the criteria for assessing an infringement of fundamental rights and to draw attention to the need to develop an appropriate methodology in the practice of Constitutional Court of Latvia. The aim of the Bachelor’s thesis is achieved through the study and analysis of the Constitutional Court's case law, relevant law and legal doctrine.
