Futbola federāciju noteikumu, kas paredz pienākumu komandām reģistrēt un izmantot minimālo nacionālas federācijas sagatavoto spēlētāju skaitu, atbilstība Eiropas Savienības konkurences tiesībām

Abstract

Bakalaura darbā tiek vērtēts, vai Eiropas Futbola asociāciju savienības (UEFA) un Eiropas nacionālo futbola federāciju izstrādātie noteikumi, kas paredz pienākumu komandām reģistrēt un izmantot minimālo nacionālas federācijas sagatavoto spēlētāju skaitu, atbilst aizliegtās vienošanās definīcijai un vai varētu tikt piemērots kāds no atbrīvojumiem. Darba ietvaros tiek aplūkota futbola sacensību reglamentācija un “home-grown players” noteikuma būtība. Tiek izvērtēts futbola federāciju statuss ES konkurences tiesībās, noteikuma ietekme uz “tirdzniecību starp dalībvalstīm”, noteikuma izpratne kā rīcība, kuras “mērķis vai sekas” ir nepieļaut, ierobežot vai izkropļot konkurenci, kā arī iespējamie rīcības attaisnojumi.

This bachelor’s thesis examines whether the regulations established by the Union of European Football Associations (UEFA) and the European national football federations, which require teams to register and use a minimum number of players trained by the national federation, constitute an agreement prohibited under Article 101 TFEU. Furthermore, it analyses the potential applicability of any exemptions to these regulations. Within the thesis, the author analyses the regulation of football competitions, the nature of the "home-grown players" rule, the status of football federations in EU competition law, the impact of the rule on trade between member states, the interpretation of the rule as an action whose object or effect is the prevention, restriction or distortion of competition, as well as possible justifications for the action.
