Īpašumtiesību digitalizācija un ar to saistītie tiesiskie aspekti

Abstract

Maģistra darba tēma ir īpašumtiesību digitalizācija un ar to saistītie tiesiskie aspekti. Kā tas ir novērots praksē, jebkura tehnoloģiskā novitāte parādās vispirms un normatīvais regulējums tikai vēlāk. Tā arī blokķēdes tehnoloģija un kriptoaktīvi tika izveidoti vispirms un tikai šobrīd top normatīvais ietvars šo tehnoloģiju izmantošanai. Darba mērķis ir analizēt tiesiskos aspektus saistībā ar īpašumtiesību digitalizāciju, izmantojot blokķēdes tehnoloģiju, analizējot blokķēdes tehnoloģiju no tās tehnoloģiskā un vēsturiskā aspekta, Latvijas un citu valstu tiesisko regulējumu attiecībā uz kriptoaktīviem kā civiltiesību objektu un īpašuma priekšmetu, iespēju izmantot blokķēdes tehnoloģiju zemesgrāmatu darbībai, kā arī tiesiskos aspektus īpašumtiesību nodošanai, izmantojot neatvietojamos žetonus.

The topic of the master thesis is digitisation of property rights and related legal aspects. As it has been observed in practice, any technological innovation appears first and the legal framework only later. Thus, blockchain technology and cryptoassets were developed first and it is only now that the regulatory framework for the use of these technologies is emerging. The aim of this thesis is to analyse the legal aspects of digitisation of property rights using blockchain technology, by analysing blockchain technology from its technological and historical aspects, the legal framework in Latvia and other countries regarding cryptoassets as an object of civil law and property, the possibility of using blockchain technology for performance of Land Register as well as the legal aspects of transfer of property rights using non-fungible tokens.
