Procesuālais huligānisms kriminālprocesā

Abstract

Maģistra darba tēma ir “Procesuālais huligānisms kriminālprocesā”, kuras ietvaros tiek apskatīts procesuālā huligānisma jēdziens, tā procesuālā būtība, izpaušanas veids un regulējums Kriminālprocesa likumā un citās Latvijas tiesību nozarēs, izvēlēta pieeja ārvalstu kriminālprocesuālajā regulējumā, definējot aizliegumu negodprātīgi izmantot savas procesuālās tiesības kriminālprocesā, izraisītās sekas un ietekmi uz procesu, apkarošanas mehānismi un procesuālā reakcija. Darba mērķis ir izpētīt un nostiprināt jēdziena “procesuālais huligānisms” vispārīgo un kriminālprocesuālo izpratni Latvijas tiesību sistēmā, apskatīt jēdziena rašanas pirmsākumus un izcelšanās avotus, sniegt iespējamo definīciju, identificēt personu loku, kas nodarbojas ar procesuālo huligānismu un biežāk izmantotus paņēmienus, izpētīt kriminālprocesuālo regulējumu saistībā ar aizliegumu negodprātīgi izmantot savas procesuālās tiesības kriminālprocesā, apskatīt ietekmi uz procesu, apkarošanas līdzekļus un likumā iestrādātos reaģēšanas mehānismus. Maģistra darba pētījumam ir izteikta aktualitāte un novitāte kriminālprocesuālo tiesību nozarē, kas būtu uzskatāms par ierosinājumu turpmākiem pētījumiem un pamats diskusijām. Maģistra darbs būs lietderīgs un interesants kriminālprocesa praktiķiem, izmeklētajiem, prokuroriem, tiesnešiem, kā arī tiesību pētniekiem, tiesību zinātnes studentiem un jebkuram citam, kam interesē krimināltiesības.

The topic of the master's thesis is "Procedural hooliganism in criminal proceedings", which examines the concept of procedural hooliganism, its procedural essence, the way of disclosure and regulation in the Criminal Procedure Law and other branches of Latvian law, the chosen approach in foreign criminal procedural regulation, defining the prohibition of dishonestly using one's procedural rights in criminal proceedings, the consequences and impact on the process, coping mechanisms and procedural response. The aim of the work is to investigate and strengthen the general and criminal procedural understanding of the concept of "procedural hooliganism" in the Latvian legal system, to review the origins of the concept and the sources of its emphasis, to provide a possible definition, to identify the circle of persons who engage in procedural hooliganism and more frequently used techniques, to study the criminal procedural regulation in relation to the prohibition of dishonestly using one's procedural rights in criminal proceedings, to examine the impact on the process, the means of combating and the reaction mechanisms incorporated in the law. The study of the master's thesis has a distinct relevance and novelty in the field of criminal procedural law, which should be considered as a proposal for further research and discussions. The master's thesis will be useful and interesting for practitioners of criminal procedure, investigators, prosecutors, judges, as well as legal researchers, students of legal science and anyone else who is interested in criminal law.
