Administratīvā pārkāpuma procesa īpatnības atsevišķās lietu kategorijās

Abstract

Maģistra darbā “Administratīvā pārkāpuma procesa īpatnības atsevišķās lietu kategorijās” tiek pētīts transportlīdzekļa īpašnieka atbildības normatīvo aktu regulējums Latvijā un tā problēmas praksē. Darbā tiek pētītas vairākas tiesību normas, kas nosaka transportlīdzekļa īpašnieka atbildību, atbildības piemērošanas juridisko pamatu, gadījumus, kad praksē tiek pielietota transportlīdzekļa īpašnieka atbildība, gadījumus, kad tās piemērošana tiek pielietota, neievērojot tiesību normas un gadījumus, kad īpatnības netiek izmantotas. Maģistra darbā tiek sniegti arī ierosinājumi kā uzlabot normatīvo aktu regulējumu. Darbā tiek analizēti transportlīdzekļa īpašnieka atbildības piemērošanas nosacījumu un to atbilstība mērķim. Kā arī darbā tiek pētīta transportlīdzekļa īpašnieka atbildības ietekme uz citām personām. Īpatnību ietvaros tika analizēta arī prakse saistībā ar atsevišķa ilgstoša administratīvā pārkāpuma konstatēšanu.

In the master's thesis “Peculiarities of the administrative violation process in certain case categories”, are studied the regulation of the legal acts of the vehicle owner's responsibility in Latvia and its problems in practice. In the master's thesis are studied several legal norms, that determinate responsibility of the vehicle owner, the legal basis for the application of responsibility, cases when the responsibility of the vehicle owner is applied in practice, cases when its application is applied without observing the legal norms and cases when the peculiarities of the process are not used. The master’s thesis provides suggestions on how to improve the existing regulatory acts. There are also analyzed conditions of application of the responsibility of the vehicle owner and their compliance with the purpose. In the thesis is studied the impact of the vehicle owner's responsibility on other persons. Within the framework of the peculiarities, was also analyzed the practice related to the determination of a separate long-term administrative violation.
