Būtisku apstākļu izmaiņa kā izņēmums no pacta sunt servanda principa

Abstract

Bakulaura darba ietvaros autores uzdevums ir izpētīt būtisku apstākļu izmaiņu klauzulas attīstību, secīgi noskaidrot tās piemērošanas priekšnoteikumus, kā arī apskatīt regulējumu dažādos starptautiskajos avotos. Pētījuma mērķis ir noskaidrot apstākļu izmaiņu doktrīnas saturu un izvirzīt secinājumus par nepieciešamību ieviest būtisku apstākļu izmaiņu kā izņēmumu no pacta sunt servanda principa Latvijas tiesību sistēmā. Rezultātā autore sniedz savu skatījumu par būtisku apstākļu izmaiņu un piedāvā veikt izmaiņas Civillikumā.

Within the scope of this paper author's main tasks were to research development of the clause for significant changes, to sequentially clarify the prerequisites for its application, as well as to review the international regulation in various sources. The purpose of the study is to clarify the content of the doctrine of change of circumstances and draw the conclusion on the need to introduce change of circumstances as an exception to the principle of pacta sunt servanda in the Latvian legal system. As a result, the author presents her point of view on a principle of change in circumstances and proposes to make changes with the rules of the Civil Law.
