Cilvēka orgānu un audu nelikumīga izņemšana

Abstract

Darbā „Cilvēka orgānu un audu nelikumīga izņemšana” tiek juridiski analizēts viens no nodarījumiem pret personas veselību, kas noteikts Krimināllikuma 139.pantā. Šāds noziedzīgs nodarījums tiešā nozīmē apdraud ne tikai cilvēka veselību, bet arī cilvēka pamattiesības un cieņu pret autonomiju. Kopumā darbā ir ietvertas trīs daļas, kas skaidro orgānu un audu ētisko un tiesisko principu mijiedarbību un to problēmjautājumus. Tiek apskatītas tādas sfēras, kā orgānu un audu izņemšana, no dzīva un miruša donora; orgānu un audu ziedošana; orgānu transplantācija, to iegāde un pārdošana; tiesu prakse. Salīdzinošai izpētei ir izmantoti Igaunijas, Lietuvas, Francijas, ASV un Singapūras tiesību akti, kas sniedza ieskatu šo valstu regulējumā, ļāva izpētīt un salīdzināt pastāvošās normas, kas skar orgānu un audu transplantāciju. Kā arī sniedza ieskatu par regulējumu, kas būtu ieviešams arī Latvijas Republikas tiesību aktos.

In bachelor`s work “The illegal removal of organs and tissues” are analyzed and reviewed one of the crimes against the human health, criminal responsibility of this crime regulates the 139th Article of Criminal Law. This crime not only threatens human health, but also affects fundamental human rights and rights to autonomy. The work consists of three parts, in which are considered the legal principles of regulation of illegal removal of organs and tissues and also reviewed ethical issues related to the illegal removal of human organs and tissues. In the work are considered the spheres, which are related to removal of organs and tissues of living and dead donor; donating of organs and tissues; organ transplantation; buying – selling human organs. In this bachelor`s work is viewed the legal regulation of the other countries such as Estonia, Lithuania, France, USA, Singapour. Legal regulation of foreign countries allows to compare the legal provisions relating to the illegal transplantation of the tissues and organs. And also give proposal of the legal regulation to be introduced by the legislation of the Republic of Latvia.
