Bērnu tiesības uz aizsardzību vardarbības gadījumos ģimenē

Abstract

Bakalaura darba mērķis ir analizēt bērna tiesības uz aizsardzību no vardarbības ģimenē. Proti, apskatīt pašu vardarbības jēdzienu gan Latvijas normatīvajos aktos, gan arī veikt salīdzinājumu ar ārvalstu, Lietuvas un Igaunijas, sniegtajām definīcijām. Aplūkot vardarbības veidus, kā arī izpētīt procedūru vardarbības konstatēšanā un novēršanā, kas tiek norādīta Latvijas normatīvajā regulējumā. Viens no darba uzdevumiem ir arī ielūkoties valsts institūciju iesaistē un nozīmē, kā arī to savstarpējā sadarbībā, un visbeidzot apskatīt sekas, kādas var iestāties pastāvot vardarbībai, kas tiek vērsta pret bērnu. Darba rezultātā tiek izvirzīti autores priekšlikumi Latvijas normatīvo aktu papildināšanai, piedāvājot Bāriņtiesas likuma un Bērnu tiesību aizsardzības likuma grozījumus.

The aim of the paper is to analyze the child’s right to protection from domestic violence. Namely, to examine the concept of violence itself both in Latvian regulatory acts and to compare it with definitions provided by foreign countries, Lithuania and Estonia. To examine the types of violence, as well as to study the procedure for detecting and preventing violence, which is indicated in Latvian regulations. One of the enabling objectives of the paper is also to look into the involvement and meaning of state institutions, as well as their mutual cooperation, and finally to examine the consequences that can occur when violence is directed against a child. As a conclusion, the author’s proposals are put forward for supplementing Latvian regulatory acts, proposing amendments to the Law on Orphan’s and Custody Courts and the Law on the Protection of Children’s Rights.
