Ārstniecības personu civiltiesiskā atbildība

Abstract

Bakalaura darba tēma “Ārstniecības personu civiltiesiskā atbildība”. Darba mērķis ir izpētīt un analizēt ārstniecības personu civiltiesiskās atbildības tiesisko saturu, identificēt galvenos problēmjautājumus normatīvajā regulējumā un tā piemērošanā, kā arī sniegt ieskatu tiesu prakses tendencēs. Darba uzdevums ir veikt normatīvo aktu analīzi, judikatūras izpēti un salīdzinošo analīzi ar Anglijas tiesību sistēmu, kas ļauj izvērtēt Latvijas tiesiskā regulējuma efektivitāti un atšķirības pacientu tiesību aizsardzības jomā. Darba ietvaros tiek pētīts, kādos gadījumos ārstniecības persona var tikt saukta pie civiltiesiskās atbildības, kādi ir šīs atbildības priekšnoteikumi un kā praksē tiek vērtēta veselībai nodarītā kaitējuma atlīdzināšana pacientiem.

The topic of the bachelor’s thesis is “Civil Liability of Medical Practitioners”. The aim of the work is to explore and analyze the legal content of civil liability of medical practitioners, to identify the main issues within the regulatory framework and its application, as well as to provide insight into trends in judicial practice. The tasks of the thesis is to carry out an analysis of legal acts, examine relevant case law, and conduct a comparative analysis with the legal system of England. This approach allows for an evaluation of the effectiveness of the Latvian legal framework and highlights the differences in the protection of patients’ rights. The research focuses on identifying the circumstances under which a medical practitioner can be held civilly liable, the prerequisites for such liability, and how compensation for harm caused to a patient’s health is assessed in practice.
