Brīvprātīgas paternitātes atzīšanas un apstrīdēšanas institūti: tiesiskā evolūcija, regulējums un piemērošanas aspekti

Abstract

Bakalaura darbā “Brīvprātīgas paternitātes atzīšanas un apstrīdēšanas institūti: tiesiskā evolūcija, regulējums un piemērošanas aspekti” tiek analizēta minēto institūtu vēsturiskā attīstība, normatīvais regulējums un piemērošanas aspekti dažādos vēstures periodos Latvijas Republikas teritorijā. Pētījuma mērķis ir noskaidrot, kā tiesību attīstība un spēkā esošais normatīvais regulējums nodrošina bērna likumisko interešu aizsardzību, īpaši attiecībā uz viņa tiesībām zināt savu bioloģisko izcelsmi un augt stabilā ģimenes vidē. Darbā tiek izvērtēta arī nepieciešamība līdzsvarot bērna un citu iesaistīto personu likumiskās intereses, kā arī identificētas iespējamās problēmas tiesību piemērošanā, piedāvājot to risinājumus.

The bachelor’s thesis “Institutes of Voluntary Acknowledgment and Contestation of Paternity: Legal Evolution, Regulation, and Application Aspects” examines the historical development, legal regulation, and application of these institutes across different time periods within the territory of the Republic of Latvia. The aim of the thesis is to explore how the evolution of legal norms and the existing regulatory framework ensure the protection of the child's legal interests, including the right to know their biological origin and to grow up in a stable family environment. The thesis also assesses the balancing of interests between the child and other involved parties, as well as identifies potential issues in the application of the law, offering solutions to adress them.
