Bērna tiesību uz identitāti ģenēze Latvijā un to apdraudējums adopcijas tiesiskā regulējuma kontekstā

Abstract

Atslēgvārdi: bērnu tiesības, adopcija, personas identitāte Promocijas darbs sniedz padziļinātu ieskatu bērnu tiesību uz identitāti un adopcijas mijiedarbības problemātikā Latvijā, izvērtējot adopcijas institūta kapacitāti Latvijā nodrošināt bērnu tiesību uz identitāti ievērošanu. Darbā reflektēta personas identitātes būtība un tās rašanās aspekti, kā arī piedāvāts salīdzinošs pētījums par personas tiesību uz identitāti vēsturisko attīstību un aktuālo situāciju lielākajā Eiropas valstu daļā. Darbā veikta atbilstošā starptautiskā, Eiropas Savienības un Latvijas tiesiskā regulējuma analīze, aplūkojot to Eiropas Cilvēktiesību tiesas un Latvijas tiesu tvērumā. Atsevišķi analizēts bērna interešu aspekts kā bērna tiesību uz identitāti noteicošais vērtēšanas kritērijs, akcentējot bērna interešu pārākuma īstenošanas problēmas adopcijas gadījumā.

Keywords: children rights, adoption, person’s identity The dissertation provides an in-depth insight into the problem of the children's rights to identity and intercourse of adoption in Latvia, assessing the capacity of the adoption institute in Latvia to ensure the implementation of children's rights to identity. The paper reflects on person's identity and it’s forming aspects, as well as holds a comparative study on the historical development of the right to identity and the current situation in the majority of European countries. The dissertation provides the analysis of the relevant international, European Union and Latvian legal framework, discussing the same in the context of the European Court of Human Rights and the Latvian courts. The aspect of children's interests as a criterion for evaluating the children's right to identity has been also particularly analyzed.
