Brīvibas atņemšanas soda progresīvā izpildes sistēmā

Abstract

Katru gadu brīvības atņemšana soda izpilde notiek saskaņā ar progresīvo izpildes sistēmu, kas paredz pakāpenisku soda izciešanas režīma mīkstināšanu vai pastiprināšanu. Brīvības atņemšanas soda progresīvās izpildes sistēmas piemērošana dažādās valstīs atšķiras. Bakalaura darba mērķis ir izpētīt brīvības atņemšanas soda progresīvās izpildes sistēmu Latvijā un tās salīdzināšanu ar ārvalstu regulējumu, rezultātā sniedzot secinājumus un priekšlikumus tās pilnveidei. Mērķa sasniegšanai autors izvirzījis sekojošus uzdevumus – izpētīt brīvības atņemšanas soda vēsturisko attīstību, soda jēdzienu, tiesisko regulējumu, iestāžu sistēmu Latvijā un tās funkcijas, analizēt brīvības atņemšanas soda progresīvo izpildi slēgtajos un atklātajos cietumos Latvijā, salīdzināt brīvības atņemšanas soda progresīvo izpildi Latvijā, Somijā, Polijā un Norvēģijā. Autors salīdzināja brīvības atņemšanu soda progresīvās izpildes sistēmu Somijā, Polijā un Norvēģijā. Bakalaura darba tapšanas procesā autors konstatējis, ka Latvijā pēdējos gados notiek brīvības atņemšanas soda progresīvās izpildes sistēmas pilnveidošana, tādējādi pietuvinot soda progresīvās izpildes sistēmas principus un piemērošanu tādām pasaules progresīvām valstīm kā, piemēram, Somija un Norvēģija.

Every year, the execution of a prison sentence takes place in accordance with the progressive execution system, which provides for a gradual softening or strengthening of the sentence serving regime. The application of the progressive execution system of a prison sentence varies in different countries. The aim of the bachelor's thesis is to study the progressive execution system of a prison sentence in Latvia and its comparison with foreign regulations, as a result of which conclusions and proposals for its improvement are provided. To achieve the goal, the author has set the following tasks - to study the historical development of a prison sentence, the concept of a sentence, the legal framework, the institutional system in Latvia and its functions, to analyze the progressive execution of a prison sentence in closed and open prisons in Latvia, to compare the progressive execution of a prison sentence in Latvia, Finland, Poland and Norway. The author compared the progressive execution system of a prison sentence in Finland, Poland and Norway. In the process of writing his bachelor's thesis, the author has determined that in recent years Latvia has been improving the progressive execution system of prison sentences, thus bringing the principles and application of the progressive execution system closer to such progressive countries of the world as, for example, Finland and Norway.
