Valsts amatpersonu imunitāte starptautiskajās tiesībās pēc sava amata pamešanas

Abstract

Bakalaura darba “Valsts amatpersonu imunitāte starptautiskajās tiesībās pēc sava amata pamešanas” aktualitāte ir saistīta ar valsts amatpersonas imunitātes tēmas aktualizēšanos saistībā ar SKT lēmumiem attiecībā pret Krievijas Federācijas prezidentu un Izraēlas premjerministru. Darba mērķis ir atbildēt uz pētījuma jautājumu – vai valsts amatpersonām ir imunitāte starptautiskajās tiesībās pēc sava amata pamešanas? Darbā tiks pētīti valsts amatpersonu imunitātes veidi, to atšķirības, gan starptautisko, gan nacionālo tiesu pieeja, skatot krimināllietas pret bijušajām valsts amatpersonām. Lai sasniegtu mērķi, tiks veikti sekojoši uzdevumi: 1) valsts amatpersonas un tās imunitātes jēdzienu izpēte, 2) valstu nacionālo un starptautisko tiesu prakses lietās pret valsts amatpersonām izpēte. Atslēgas vārdi: valsts amatpersona, imunitāte ratione personae un ratione materiae, imunitāte pēc amata pamešanas.

The relevance of the bachelor's thesis "Immunity of public officials in international law after leaving office" is related to official immunity topic’s regained relavence in connection with the decisions of the ICC regarding the President of the Russian Federation and the Prime Minister of Israel. The aim of the thesis is to answer the research question - do public officials have immunity in international law after leaving office? The thesis will study the types of immunity of public officials, their differences, the approach of both international and national courts when considering criminal cases against former public officials. To achieve the goal, the following tasks will be performed: 1) study of the concepts of public officials and their immunity, 2) study of the practice of national and international courts of states in cases against public officials.
